End User License Agreement

This End User License Agreement ("EULA") governs your installation and use of the Phalangix Launcher and any game distributed by us, currently SeaWar Sandbox V1 (together, the "Software"). Your use of the website itself is governed by our Terms of Service. By installing or using the Software, you agree to this EULA. If you do not agree, do not install or use the Software.

1. License grant

Phalangix grants you a free, personal, non-exclusive, non-transferable, revocable license to download, install, and use the Software on devices you own or control, for personal and non-commercial entertainment. This is a license, not a sale. No ownership of the Software passes to you.

2. The software is free

The Software is provided at no cost. There is no purchase, no subscription, and no in-game payment of any kind. The whole game is yours for free.

3. Ownership

The Software and all intellectual property in it, including the Phalangix name and logo, the SeaWar name and logo, the in-game art, music, code, and design, are owned by Phalangix and protected by copyright and trademark law. All rights not expressly granted to you are reserved.

4. Restrictions

Do not sell, rent, lease, sublicense, or redistribute the Software or its installer on third-party mirrors without our written permission. Linking to phalangix.com is always welcome.
Do not reverse engineer, decompile, or disassemble the Software, except to the extent that applicable law expressly permits it (the interoperability exception under EU Directive 2009/24/EC remains available).
Do not remove, alter, or obscure any copyright, trademark, or license notices in the Software.
Do not use the Software to build a competing product, or in any way that breaks the law.

5. Updates

The launcher may download and install updates to itself and to the game so you always have the current version. You can change the update behaviour in the launcher settings. Continued use after an update means you accept this EULA as it applies to the updated Software.

6. Open-source and third-party components

The Software includes open-source and third-party components that are licensed under their own terms. Those terms apply to those components and, where they conflict with this EULA, prevail for the component in question. A summary of the main components and their licenses is on our Open Source Licenses page, and the full license texts are included with the Software itself.

7. Save files and local data

The game stores your progress and settings locally on your device. The launcher stores its own settings and logs locally. We do not access, collect, or transmit your save files. Uninstalling the game may remove your saves, so back them up if you want to keep them.

8. Disclaimer of warranty

The Software is provided "as is" and "as available", without warranty of any kind, express or implied. We do not guarantee that the Software will be uninterrupted, error-free, or free of any harm to your computer, or that defects will be corrected.

9. Limitation of liability

To the maximum extent permitted by applicable law, Phalangix shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of save files, or loss of playtime, arising from your use of the Software. This does not limit liability for damages that cannot be excluded under applicable consumer protection law.

10. Termination

This license ends automatically if you breach any term of this EULA. You may end it at any time by uninstalling the Software. On termination you must stop using the Software and remove it from your devices. Sections on ownership, disclaimer of warranty, and limitation of liability survive termination.

11. Governing law

This EULA is governed by the same law and jurisdiction as our Terms of Service. Mandatory consumer protection rights in your country or state of residence apply regardless of this section and are not waived.
