Terms of Service

These Terms of Service ("Terms") govern your use of the Phalangix website at phalangix.com, any subdomain we operate, the Phalangix Launcher, and any game distributed by us. By accessing the site or downloading our software, you agree to these Terms.

1. The service

Phalangix operates a website and distributes games made by the studio. Our current title is SeaWar Sandbox V1, a single-player offline naval sandbox. The site also hosts the Phalangix Launcher, an installer and updater for our games.

2. Permitted use

You may browse the site, download the launcher, install and play our games for personal, non-commercial use. You may write about our games, stream gameplay, post screenshots and videos, and share your impressions freely.

3. Prohibited use

• Do not attempt to disrupt, attack, or overload the site or the launcher distribution servers.
• Do not reverse engineer the launcher or game beyond what is permitted by applicable law (interoperability exception under EU Directive 2009/24/EC remains available).
• Do not redistribute the launcher installer or game files on third-party download mirrors without written permission. Linking to phalangix.com is always welcome.
• Do not impersonate Phalangix or claim affiliation that does not exist.
• Do not use the contact form to send unsolicited commercial messages, malware, or illegal content.

4. Intellectual property

All original assets on this site - including the Phalangix name, logos, the SeaWar name and logo, in-game art, music, written content, source code, and design - are owned by Phalangix and protected by copyright and trademark law.

You may use our screenshots and short video clips in editorial coverage, reviews, streams, and let's play videos, provided you do not modify them in a way that misrepresents the game or studio.

5. User-submitted content

If you send us a message through the contact form, you grant us the right to read it and reply. We will not publish your message or contact details without your explicit consent.

6. Free software

SeaWar Sandbox V1 and the Phalangix Launcher are free. There is no purchase, no subscription, and no in-game payment of any kind. The whole game is yours at no cost.

7. Disclaimer of warranty

The site, the launcher, and any games are provided "as is", without warranty of any kind, express or implied. We do not guarantee that the site will be uninterrupted or error-free, or that any defects will be corrected. We do not guarantee that downloads or saves will be free of any harm to your computer.

8. Limitation of liability

To the maximum extent permitted by applicable law, Phalangix shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of save files, or loss of playtime, arising from your use of the site, launcher, or any game.

This does not limit liability for damages that cannot be excluded under applicable consumer protection law.

9. Third-party links

The site may link to external services (for example, Discord, YouTube, X). We are not responsible for the content, privacy practices, or availability of those third-party sites. Their terms govern your use of them.

10. Changes

We may revise these Terms at any time. Updated versions will be posted on this page with a new "Last updated" date. Continued use after a revision means you accept the new Terms. If you disagree, stop using the site.

11. Governing law and jurisdiction

These Terms are governed by the laws of the European Union and the country in which Phalangix is registered, without regard to conflict-of-law principles. Any dispute will be resolved in the competent courts of that jurisdiction.

US visitors: Because the website is hosted in the United States and is accessible to US residents, US federal and applicable state law (including, where relevant, the California Consumer Privacy Act) may also apply to your use of the site. Mandatory consumer protection rights in your state of residence are not waived by these Terms.
